Court Of Protection

The Court of Protection is a specialist court for all issues relating to people who have been assessed under the Mental Capacity Act (2005) (MCA) as lacking in capacity required to make specific decisions. 
 
Phoenix Psychology Group offer specific assessments of an individual’s capacity in a range of areas, including

  • Capacity to conduct proceedings and to instruct a Solicitor
  • General health and social care
  • Financial affairs
  • Capacity to enter into sexual relationships
  • Refusal of specific treatments
  • Contact with family members
  • Decisions regarding where an individual should reside / caregiving arrangements

These assessments will include a Cognitive Assessment and in addition a Psychologist will ask a range of interview questions and (if appropriate) administer relevant measures in order to formulate an opinion on whether a client has capacity within the area of question.  Broader issues of context, family relationships and professional input are also likely to be assessed to inform the court of matters relevant to the protected party. 

The Phoenix Psychology Group also has expertise within most aspects relevant to the Court of Protection and regularly receives commissions to assess individuals in order to assist the court in making decisions. We are also able to provide training on understanding and assessing capacity and our Director has provided input to the Judicial College training on assessing capacity.
